Bloomberg BNA Quotes Carter Strang on Toxic Take-Home Suits

Bloomberg BNA’s Toxics Law ReporterTM quoted Carter Strang in “Fewer Early Dismissals Predicted for New Jersey Toxic Take Home Suits.” The article focuses on New Jersey cases that seek liability for toxic substances sent home via workers’ clothing. Due to last week’s New Jersey Supreme Court ruling (Schwartz v. Accuratus Corp., 2016 BL 215980, N.J., No. A-73-14-076195, 7/6/16), corporate defendants may experience challenges in getting such cases dismissed. The court ruled that exposed non-spouses may pursue claims, but failed to construct a bright-line rule. Instead, the court directed trial courts to weigh each case’s specific facts to determine liability.

“One thing is for sure – it will make summary judgment less likely to be granted,” Carter said. “These cases will be fleshed out case-by-case and state-by-state in those states that permit claims against premises owners.
