Tucker Ellis Scores Trial Win For O’Neill Innovations

On December 6, a unanimous Delaware federal jury returned a complete defense verdict for O’Neill Innovations and related parties on contract and tort claims brought by a former business partner and a former independent consultant (Kyle, et al. v. O’Neill Innovations, et al.). The jury also returned a favorable verdict for O’Neill on its counterclaim, finding that the former business partner misappropriated trade secrets during his tenure at an O’Neill distribution company. The two plaintiffs originally had sought millions in damages, including punitive damages on their tort claims, and asserted that they were entitled to a share of past and future profits from O’Neill’s successful Maxfit® line of gloves. After the one-week trial, the jury deliberated for just over two hours before reaching its verdict.

O’Neill was represented at trial by John Q. Lewis and Seth Linnick.
